1.If either Seller or Buyer or anyone to whom either Seller or Buyer transmits Confidential Informationin accordance with this Clause 19 is,in the circumstances described in Sub-Clause 19.2(a)(vi),requested or required (in connection with any proceeding) to disclose any Confidential Information (the “Receiving Party”),the Receiving Party shall give to Seller or Buyer,as the case may be,(the “Disclosing Party”) prompt written notice of such request or requirement so that the Disclosing Party may seek an appropriate protective order or other remedy and the Receiving Party shall cooperate with the Disclosing Party to obtain such protective order.If such protective order or other remedy is not obtained or the Disclosing Party waives compliance with the relevant provisions of this Master Agreement,the Receiving Party shall be entitled to furnish only that portion of the Confidential Information which,in the opinion of such Receiving Party’s legal counsel,is legally required to be disclosed and,upon the Disclosing Party’s request,use commercially reasonable endeavours to obtain assurances that confidential treatment will be accorded to such Confidential Information.
2.The Vessel should be able to unload at an average rate equal to or greater than
[ten thousand (10,000)] cubic meters per hour against a head of ninety-five (95)
meters of LNG at the point of coupling between the LNG Tanker's discharge manifold and the unloading arms at Buyer's Facilities or otherwise be able to unload the entire cargo within [fourteen (14)] hours without exceeding prudent operating conditions excluding the time for connecting,cooling down,starting up pumps,ramping up,ramping down for stripping at end of discharge,custody transfer measurement and disconnecting.
