新《刑法》第48条规定了死刑和死缓适用的对象以及程序.作为我国独具特色的刑罚制度之一的死缓制度,在新中国历史上发挥了不可磨灭的作用,随着社会的发展和形势的变化,如何更好的发挥“死缓”的价值,更好的让“死缓”为法律所服务,这就涉及到对死缓的合理适用问题.正确适用并不断完善死缓制度,对维护社会安定和实现司法公正具有重要的意义.
Article 49 of the new “Criminal Law” stipulates the applicable subjects and due procedures for the death penalty and the stay of execution.The stay of execution system,as one of China’s unique criminal punishment systems,has played an indelible role in New China’s history,with the development of society and the changes in situations,that how to better exert the values of the stay of execution and how to make stay of execution better serve the laws involves the issue that the stay of execution should be reasonably applied.The right application and the increasing perfection of the stay of execution system are extremely important in keeping the society stabilized and maintaining a fair justice system.
