投标保证金(bid security)是为了保护买方免遭因投标人的行为而蒙受的损失,买方在因投标人的行为受到损害时可根据规定没收投标人的投标保证金.
下列任何情况发生时,投标保证金将被没收：
（1）投标人在投标函格式中规定的投标有效期内撤回其投标；
（2）中标人在规定期限内未能：（a）根据规定签订合同；或根据规定接受对错误的修正； （b）根据规定提交履约保证金.
根据规定,投标人应提交规定金额的投标保证金,并作为其投标书的一部分.
投标保证金应用投标货币或另一种可能自由兑换的货币表示,并采用下列任何一种形式：
(1)由一家在买方本国的或国外的信誉好的银行用招标文件提供的格式或买方接受的其他格式出具的银行保函或不可撤销的信用证,其有效期应超过投标有效期三十（30）天；
(2)银行本票、保付支票.
（3）现金.
未中标人的投标保证金,将在买方规定的投标有效期满后三十（30）天内退还.但是,下列任何情况发生时,投标保证金将被没收：
1.投标人在招标文件中规定的投标有效期内撤回其投标；
2.中标人在规定期限内未能：
(1)根据投标人按规定签订合同或按规定接受对错误的修正；
(2)根据招标文件规定未提交履约保证金.
3.投标人采用不正当的手段骗取中标.
