摘要:
数罪并罚是我国刑法适用基本制度之一,它对遏制犯罪现象的发生、建立良好的社会秩序意义重大.我国刑法在数罪并罚上采用的是以限制加重原则为主,以吸收原则和并科原则为补充的综合原则.其在司法理论和审判实践中仍存在立法上的不足,我国刑事立法在这方面的疏漏是重要原因之一,有进一步完善的必要.本文分析数罪并罚原则,对司法理论和实践中的几个热点、难点问题进行了探讨.

Abstract:
Combined Punishment is the basic system of China's Criminal Law applies one of its curb the occurrence of the phenomenon of crime,establish a good social order of great significance.Combined Punishment in China's Criminal Law was adopted on the principle of increasing restrictions mainly to absorb the principles and the principle of additional branches and the comprehensive principle.Their trial in the judicial theory and in practice there is still a lack of legislation,China's criminal legislation in this regard is an important omission one of the reasons,the need to further improve.Combined Punishment of this principle,the administration of justice theory and practice in several hot and difficult issues were discussed.
