两大法系分别借鉴吸收对方的优点来弥补自身的不足.中国同样也受到了这个大趋势的冲击,势必对自身的司法体制带来一定的变化.我国应根据具体国情对判例加以完善和使用,建立具有中国特色的司法体系.本文从我国的司法现状分析,试设想构建判例法与制定法互相弥补、共同混合作用于全社会的法律形式.
