新的劳动合同法于2007年6月29日通过,将于明年1月1日实施,在原有的《合同法》《劳动法》的基础上更加完善了我国劳动合同制度,有效保护了劳动者的合法权益,加大了公平、诚实信用原则的实施力度.劳动合同的无效,从订立的时候起就没有法律约束力,确认劳动合同部分无效的,如果不影响其余部分的效力,其余部分仍然有效.本文着重从劳动合同无效的认定入手结合无效的几种情形,并探讨了对无效劳动合同认定后的处理.

Abstract:
The new labor contract law in June 29,2007,will be next January 1 implementation,in the original "contract law," the "Labor Law" on the basis of a more complete China's labor contract system,the effective protection of the workers the legitimate rights and interests,increase the fair,the implementation of the principle of good faith efforts.Labor contracts null and void,starting from the time set on not legally binding,confirmed some of the labor contract null and void,if not affect the rest of the effectiveness of the rest of the still valid.This paper from the labor contract null and void that start with the combination of several circumstances invalid,null and void and to explore its labor contracts found after treatment.
