【内容摘要】无独立请求权第三人制度是我国民事诉讼法中一项比较具有中国特色的制度.根据我国民事诉讼法及相关法律规定,无独立请求权的第三人,是指对原告、被告双方争议的诉讼标的没有独立的请求权,但案件的处理结果与其有法律上的利害关系,为维护自己利益而参加到原告、被告已经开始的诉讼中进行诉讼的人.但是我国现行立法对该制度存在诸多不完善之处,以致于司法实践十分的混乱.通过分析我国无独立请求权第三人制度的现实状况及缺陷,本文拟从该第三人参与诉讼的根据、参与诉讼的方式及参与诉讼以后的诉讼地位三个方面来探讨我国无独立请求权第三人制度的完善.
