The law on divorce at present is contained in the Matrimonial Causes Act (MCA) 1973.However, it is anticipated that the Family Law Act (FLA) 1996 dealing with divorce will come into effect on 1 January 1999.This Act will repeal certain sections of the MCA 1973 and will no longer require the party seeking a divorce to prove one or more of the five facts bringing about the ‘no fault’ divorce system that had been sought, but only partially achieved, by the earlier legislation.
