【内容提要】《中华人民共和国行政诉讼法》从1990年10月1日起施行,至今已实施十八年之久.《行政诉讼法》将行政机关的具体行政行为纳入到司法审查的轨道,提高了行政机关依法行政的意识,保护了公民、法人和其他组织的合法权益,对推动“民”告“官”制度的发展和社会进步发挥了重要的作用.但从我国行政诉讼的现状来看,仍然存在着许多令人担忧的问题.笔者根据自己对行政诉讼法律、法规的研究和两次独自起诉省市卫生行政部门行政不作为案件的实践,联系自己和其它人的庭审判例,对行政诉讼存在的问题及对策提出了许多全国独一无二的见解,与关心我国行政诉讼前途和命运的有识之士共同探讨,以期从立法上得到改变.
